Xeekar Solutions Subscription Agreement for "Vehicle Tracking Solution"
Section 1: Introduction
Please read this agreement (“Agreement”) carefully. This Agreement is between you (“Customer”), the original purchaser of the GPS tracking device (“Device”), and Xeekar Solutions (“Company”), the provider of the related services (“Services”). This Agreement governs all past, present, and future use of the Device and Services, including any modifications or updates.
This Agreement becomes effective when you:
- Install and activate the Device;
- Log into our website and acknowledge this Agreement;
- Use the Services;
- Purchase additional Services; or
- Utilize any Service feature.
This Agreement does not grant rights to third parties. The Device is covered by a separate limited product warranty.
Section 2: Changes to This Agreement
The Company reserves the right to modify this Agreement and the Services at any time. Changes will be posted on our website and may also be communicated via email or postal mail. Continued use of the Services constitutes acceptance of the revised terms.
Section 3: Payment
You agree to pay for the Services using an approved payment method. By providing payment details, you authorize the Company to charge for Services and amounts due under this Agreement.
- Declined payments may result in suspension or termination of Services.
- You are responsible for all applicable taxes and fees.
- Payments not received within 10 days of the due date will be considered past due. Service interruptions and reactivation fees may apply.
Section 4: Cancellation
- No refunds will be provided for unused Services.
- The purchase price of the Device is non-refundable under the product warranty.
- A reactivation charge may apply if you deactivate and later reactivate your Device.
Section 5: Usage Restrictions
- You may not resell the Services.
- Services must be used lawfully and within reasonable limits.
- Excessive or inappropriate usage may result in additional charges or service suspension.
- The Company reserves the right to charge for additional usage.
Section 6: No Transfer of Services
- Services are non-transferable.
- If you transfer ownership of a vehicle with an installed Device, you must uninstall or deactivate it before transfer.
- The new owner must be informed about the installed Device.
Section 7: Suspension and Termination of Services
Services may be suspended or terminated without prior notice if:
- You violate this Agreement;
- Payments are missed;
- You interfere with service provision;
- Services are used for illegal or inappropriate purposes;
- Communication services become unavailable due to third-party network failures or maintenance.
Section 8: Privacy Policy
The Company collects information via tracking technologies, including IP addresses, browsing behavior, device details, and location data. Data may be used for:
- Providing and improving Services;
- Personalizing content and advertisements;
- Monitoring security and troubleshooting;
- Complying with legal requirements;
- Preventing fraud and misuse.
